RULES OF THE GAME "Orange Super Cash"

Article 1: PREAMBLE

- According to law nº 2015/012 of the 16th of July 2015 fixing the rules governing games of entertainment, money and chance.

- Regarding Decree No 92/050/PM of the 17th of February 1992 laying down the rules for the authorization, operation and control of games of entertainment, money and chance.

Orange Cameroon SA, with a registered capital of 46,831,200,000 FCFA, with its main office located in Douala, Rue Franqueville, PO Box 1864 Douala, registered with the Trade and Credit Register of Douala under number RC/DLA/2002/027585, shall organize a game called "ORANGE SUPER CASH" throughout the country of Cameroon during the period from 11th July 2017 at 00:00 hours to 06 January 2018 at 23:59 pm.

Article 2: PARTICIPATION

The participation in this game is open to any major customer of Orange Cameroon who is subscribed to a prepaid or hybrid consumer offer and has been duly identified, with the exception of Orange Cameroon staff and ‘’duo’’ telephone line users made available to the staff.
To become a participant, the customer must register for the game, by sending an SMS with the word "CASH" or "GAME" to the short code 9124 and participate in the quiz by responding by SMS to the questions that will be asked.
The keyword "CASH" or "GAME" to be sent by the customer may be written in uppercase or lowercase.
The phone numbers of the game participants will be listed in the Orange Cameroon files for the purpose of determining the winners.

Article 3: PRINCIPLE AND MECHANISM OF THE GAME

The game will run for a period of one hundred and eighty (180) days.
After sending the keyword "CASH" or "GAME" by SMS to the short code 9124, a message will be automatically sent to the customer confirming his/her registration to the game, followed by an indication of the different participation options and unsubscription conditions.
Registration for the game results in daily debit of a subscription amount of three hundred (300) CFA francs (VAT included) from the client's main account during the period of validity of the game, subject to the depletion of his/her communication credit or its unsubscription.
If the customer tops up his/her account without unsubscribing, then their subscription to the game gets reactivated from the date of the top up.
After registration, the subscriber receives a series of questions on general culture daily. The number of questions is set at five (5) questions per day. Receipt of the first question of the day is related to the debit of the daily subscription fee. After the first question, the following questions are answered in response to the previous question.
For each question, numbered answers are proposed to the subscriber. The subscriber sends the number of the chosen answer by SMS to the short code 9124. Every correct answer rewarded with twenty (20) points and every incorrect answer gives him/her ten (10) points.
For the entire period of play, points are counted without resetting the counter.

Each subscriber has the option to check the accumulated points by sending "POINT" by SMS to the short code 9124.

Article 4: DESCRIPTION OF PRIZES TO BE WON

Orange Cameroon hereby submits one hundred and ninety-nine (199) prizes with a total value of thirty-seven million (37,000,000) CFA francs, consisting of daily, weekly and monthly prizes.

4.1 Daily Prizes
One hundred and eighty (180) prizes daily, each consisting of one hundred thousand (100,000) CFA francs cash are up for grabs, representing a total value of eighteen million (18,000,000) CFA francs.
4.2 Monthly Prizes
Eighteen (18) monthly prizes each consisting of five hundred thousand (500,000) CFA francs are put into play, for a total value of nine million (9,000,000) CFA francs.

4.3 The Grand Prize
A Grand Prize at the value of ten million (10 000 000) Francs CFA will be up for grabs at the conclusion of the overall promo period.

Article 5: DETERMINATION OF WINNERS

The determination of the winners is made daily, monthly and at the end of the game.
Winners will be determined every Wednesday of each week of play by electronic draw based on daily entries.
The various SMS and cumulative points cumulated by the participants, as well as the random drawings, will be supervised by a territorially competent bailiff who will draw up a report within the following four (4) days.
Subscribers with any kind of unpaid credit in Orange Cameroon’s books shall not be taken into account when determining the winners if the claim of Orange Cameroon is still due at the time of drawing up the accounts.
The winners will be confirmed after verification by the bailiff of the regularity of the counts made.
A subscriber may not win more than one prize during the period of play of the same type.
Counting and or draws could be made in the presence of the media.
Any irregularity noted by the bailiff will result in a new count or draw.
If the day scheduled for the draw or a count is a public holiday, the transactions will be postponed to the next business day.
In case of total or partial deficiency of winners, the prizes will remain the property of Orange Cameroon who will dispose of them at will.

Article 6:        DISTRIBUTION OF PRIZES

Orange Cameroon will inform each winner, by telephone call, by SMS and/or by e-mail.
In the event the winner renounces the benefit of his/her prize, the latter will become the property of Orange Cameroon which will then have the right to make use of this in any way it pleases.

The prizes will be awarded according to their nature.

6.1. Prizes of communication credits will be awarded to winners of prepaid or hybrid subscriptions by direct deposit into their respective accounts within seven (07) business days of publication of the results.
The communication credit earned under this game is deposited in the client's main account and valid for all mobile communications (voice calls to all networks, SMS to all networks and internet, bid purchases and services).
Consequently, the deactivation of an account following its contractual inactivity entails de facto the loss of the credit earned in the event that it is not yet totally consumed.
Such a situation shall be assimilated to the waiver by the winner of the profit (total or partial) of his prize. Unused credit will then become the property of Orange Cameroon, without any special formalities.

6.2. The delivery of cash prizes will be in the form of a direct deposit of Orange Money units in the customer's Mobile Money account. The winner's account will be credited with the winning amount within thirty (30) business days of the release of the results.

All prizes may be awarded in the presence of the media. The winner must present with a valid identification document at the places and dates indicated by Orange Cameroon for this purpose.
Prizes in kind are not covered by any guarantee against hidden defects and Orange Cameroon does not provide after sales service or maintenance.
The prizes distributed as part of this game are neither assignable, transferable, nor exchangeable.
Winners of prizes in kind who do not show up on the date indicated by Orange Cameroon or are not represented on that date have a period of thirty (30) days to withdraw their prizes. After this period, the non-withdrawal will be considered as a waiver of the benefit of their prizes. The said prize[s] will becomes the property of Orange Cameroon which will be able to make use of it in any way it pleases.

Article 7: CLIENTS WAIVER

Clients irrevocably waive any action against Orange Cameroon for compensation for any delay in the organization of the game, as well as for any malfunction or error due to a hardware and/or computer system failure or due to any other circumstances beyond the control of Orange Cameroon.

Orange Cameroon will take all necessary measures to remedy this type of event where applicable.

Article 8: COMMITMENT OF WINNER AND ASSIGNMENT OF OPERATING RIGHTS

The winner must accept the prize as defined in article 4.

Due to his/her mere participation in the game, the winner accepts wholly that Orange Cameroon uses, through the media, his/her name, voice and/or call number obtained in the context of the game for advertising purposes or public relations, without implying remuneration other than the gain described in Article 4.

Article 9:        LIMITATION OF LIABILITY

Orange Cameroon cannot be held liable if, due to a case of force majeure or circumstances beyond its control, the game to which these terms apply should be modified, abridged or cancelled. No indemnity may be claimed on this account.

Orange Cameroon reminds customers of the characteristics and limits of electronic communication networks and the Internet, and declines all responsibility for the consequences of their interruption and/or malfunction.

Article 10:      FRAUD

In the event of manifest fraud in connection with the game, Orange Cameroon reserves the right to exclude the participation of the offenders and initiate legal proceedings against them.

Article 11:      FORCE MAJEURE

Orange Cameroon cannot be held liable if, for reasons of “force majeure” or circumstances beyond its control, the Game must be modified, shortened or cancelled. In this case, Orange Cameroon reserves the right to extend the participation period and to postpone any announced date.
Any resulting amendments to the rules will result in a new filing with the bailiff referred to in Article 15 below.
No compensation will be owed to the customers due to the modifications of the game.

Article 12:      CONVENTION OF EVIDENCE

Orange Cameroon has set up the necessary technical means to demonstrate the participation or non-participation of a person in the game. Therefore, unless there is a manifest error, the data contained in its information systems have probative value as regards to the information resulting from computer processing relating to the Game.

Orange Cameroon may avail itself for the purposes of proof, programs, data, files, recordings, operations and other elements, in electronic formats or supports, established, received or kept in its information systems.

Customers are not to challenge the admissibility, validity or probative force of these elements if they are produced as evidence by Orange Cameroon in the context of litigation or in any other framework.

Article 13:      DEPOSIT AND COMMUNICATION OF THE RULES

The entirety of this regulation is deposited with Maître OWONA née Suzanne EDIMO, Bailiff in Douala, P.O box 15 592 Douala.
A copy of the present by-laws will be sent by the latter to any person who so requests, enclosing a stamped envelope at his address.

Article 14:      SUPEREROGATORY CLAUSE

All other texts on other Orange Cameroon commercial media (banners, posters, flyers, radio announcements, TV spot, Push SMS) relating to the game set out herein shall be considered as an annex to this regulation.

Article 15:      DISPUTE RESOLUTION

Participation in this game constitutes pure and simple acceptance of these rules by the Client.
Any litigation or dispute arising out of or in connection with these regulations will be settled amicably. In the absence of such an amicable arrangement, it is recognized exclusive jurisdiction in the courts of Douala-Bonanjo.
